Making a claim against NJ Transit is like navigating a minefield. If you are not careful your case may explode.

What to know about personal injury claims against NJ Transit.

The New Jersey Tort Claims Act governs claims against New Jersey Transit.  If you are injured in an accident caused by NJ Transit you must file a notice of claim within 90 days of the date of your accident, or your claim can be barred.  If you are hurt in an accident due to the negligence of NJ Transit you must act quickly to protect your rights. The law also requires that the injuries sustained must be "permanent" in order to obtain any settlement.   Minor or temporary injuries that heal without resulting in a permanent injury are not sufficient under the law to warrant a settlement.

Also because New Jersey Transit is self-insured, claims against New Jersey Transit are not paid by an insurance policy but rather are paid by the State. This generally makes it more difficult to get a settlement.
