Doctor’s failure to diagnose Malaria results in 4.5 Million-Dollar Settlement.

In a very unfortunate case, a toddler died from malaria, after a doctor at University Hospital allegedly failed to diagnose the disease, after the child returned from a trip to Africa several weeks earlier.

The doctor allegedly failed to perform an initial blood test, which would have revealed the disease.  This resulted in a delay in the diagnosis and the malaria advanced into a more complicated case. 

The lawsuit contended that had the doctor performed the initial blood test and properly diagnosed the disease then there was a 99% chance of the treatment being successful.  The failure to promptly diagnose allegedly led to severe complications, resulting in the child’s death. 

A lawsuit was filed in Essex County against the Hospital and doctor and resulted in this settlement the week before the case was scheduled to start a jury trial. The lawsuit included claims for the child’s pain, suffering and loss of future services to the family.
